No, Daly was disbarred, and the court’s decision was vacated for numerous reasons. See In Re Daly, 284 Minn. 567, 171 N.W.2d 818 (1969); 294 Minn. 351, 200 N.W.2d 913 (1972). Anybody who cites the Credit River decision in support of a claim for a borrower to keep his house is either ignorant of the law, or a con-artist. The Supreme Court concluded that Jerome Daly was colluding with the justice to get a favorable verdict – after he was already barred from appearing in court. HE WAS DISBARRED!

Of all the cloak-and-dagger conspriacy angles this guy is alleging, it should be a very simple matter for him to answer my very objective questions. If he cannot even do that – why should we believe anything else he has to say? It’s basic fact-checking. No respectable news outlet would ever publish this you-tube story without verifying some of the basics. And the mere existence of this lawsuit is easy to verify – if only the maker of the video would respond.

Even after the passing of the 20 days, the plaintiff must bring a motion for a default judgment. I am simply asking for the details of this lawsuit he claims to have started. So – let’s see the paperwork on the Summons, Complaint and the Motion for Default Judgment. If he can’t answer my simple questions, he should pull his video and post a retraction and an apology.

I never said he should win his lawsuit, nor did I imply that he had won his lawsuit. I am stating that the legal theory of “criminal fraud” is not something a private citizen can pursue in a lawsuit. That the judge is refusing to do anything with the lawsuit is entirely predictable because even in a default (where the defendants have not responded within the time alloted – typically 20 days), the plaintiff still must prove up its case.

I’ve been paying into the Canadian government pension plan for 33 years. It’s automatically deducted from our pay cheques, we have no choice. For 30+ years my father said there would be nothing in the pension when I retire. Unfortunately, it looks like he was right.

Spoke with an employee just last wk and it appears the banks are calling in debts that are delinquent by garnishing bank accounts.Bottom line, the customer was delinquent on a couple loans;therefore the bank just simply helped themselves to their savings and checking to bring those accounts current.Apparently, it’s in the fine print ppl;the banks r scraping for every red cent and they r taking no prisioners-Lesson:close bank accounts anon! It’s legal if you signed when opening that account!Uh oh

Really, you started a lawsuit? What is the case number? Who are your lawyers? Who specifically did you sue? In Minnesota, private citizens cannot sue for ciminal fraud – that is a power reserved to the county attorneys and the office of the attorney general. You don’t get to “win” your lawsuit just because the defendants did not answer. You still have to prove your case on the facts – and on the law. What you have described can satisfy neither.
